  1. Scope

The following Terms and Conditions apply to all orders placed through our online store by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

We do not deliver to packing stations.

Unless otherwise expressly agreed, deliveries made by a freight forwarder are generally delivered to the curb.

Our store generally offers the following payment methods:

We assume unlimited liability for claims arising from damages caused by us, our legal representatives, or our agents:

  1. in the event of injury to life, limb or health,
  2. in the event of intentional or grossly negligent breach of duty,
  3. in the case of warranty commitments, if agreed,
  4. insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of material contractual obligations due to slight negligence, liability is limited to foreseeable damages typical for this type of contract.

Otherwise, claims for damages are excluded.

  1. Dimensions and Material Deviations

Minor variations in color, texture, grain, and dimensions may occur in natural stone products, furniture, and handmade items. Such variations, which are common in the industry and typical of the material, do not constitute a material defect, provided that they do not significantly impair the product’s fitness for use.

  1. Exclusion of the right of withdrawal for custom-made products

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for which the customer’s individual selection or specification is decisive for their manufacture, or that are clearly tailored to the customer’s personal needs.

We are not obligated and are not willing to participate in dispute resolution proceedings before a consumer arbitration board.

  1. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless this is precluded by mandatory consumer protection laws.

If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive venue for all disputes arising from contractual relationships shall be our registered office in Porto, Portugal.
